“Congress does not intend for states to enforce their own immigration schemes,” Schumer said at a hearing Tuesday on Capitol Hill. “It is simply too damaging to our economy and also dangerous to our democracy, to have 50 different states be permitted to take their own direction when it comes to immigration policy.”
The SB1070 legislation which had been introduced in Arizona, began several copycat legislation in many other states, bringing about the Federal Government to put a hold on the laws until eventually america Top Court could identify whether Arizona had been inside the constitution to enact it.
The law is pretty strict in that's it will likely be a crime to not possess immigration papers at all times but Schumer is attempting to bypass this kind of a regulation by producing rules that may only enable states and nearby authorities to create these kinds of legislation below the authorization of the United states government.
Schumer was chatting at a Judiciary subcommittee meeting during the Senate but he is convinced that in any event the Supreme Court will strike down the Arizona SB1070 legislation mainly because the Court has always considered language in Article one of the constitution that the National government need to be the sole power to carry out legislation on immigration.
The proponents of the law feel it is actually widely supported and is necessary in the battle against illegal immigration within the area. Proceedings inside the Supreme Court over the law will continue tomorrow and throughout the next few days. More on the eb5 visa here.
